Welcome to True Balance App Offer. We are glad that you are a part of it now. The True Balance App for Android (“True Balance”), which is provided by Balance Hero India or Balancehero India Pvt. Ltd (in any case, “Balance Hero”), has Promo Code Program(“Promo code”, or “offer”), True Membership Program (“True Membership” or “Membership”)Referral Rewards Program (“Invite”), Extra Rewards Program(Collectively referred to as “Rewards”, “Promotions” or “offer”), Lucky Spin Promotion(“or any such programs or promotions that may be run by Balance Hero at any time, which allow registered True Balance users (each a “True Balance User”, “You”, “User”, “Referrer”, or “Participants”) earn True Balance Points(“Free Points”) which can be used in True Balance Purchase System (“Wallet” or “Gift Card”). By creating an account on True Balance, you agree to TRUE BALANCE PROMOTION TERMS & CONDITIONS (these “Terms and Conditions”). Any violation of these Terms and Conditions may lead to deletion of your account, cancellation or forfeiture of any rewards posted to your account including referrals, without prejudice to any other remedies that Balance Hero may have at law or in equity. If you do not agree to abide by these or any future terms and conditions, you are not authorized to use or access (or continue to use or access) the True Balance application or use the services offered there under. By applying to avail True Balance App Offer or any its programs or promotions or continuing to use True Balance, it shall be deemed that You have understood and voluntarily agreed to all the Terms and Conditions stated herein and the amendments thereto. In addition to these Terms and Conditions, all other regular terms and conditions such as Terms of Service shall also apply.

EXPIRY OF FREE POINTS

Free Points will expire after one year from the last use of Free Points balance available under the True Balance account of the user and the remaining Free Point shall be forfeited.

PROMOTION: EARNING & REDEEMING POINTS

True Balance Users can earn Free Points to qualify for True Balance offers in future (i) by using the Referral Rewards Program if the True Balance User invites and refers a friend who enters the referral code to create a valid True Balance account that complies with our Terms of Service and completes incentivized Task (“Tasks”) to referral network time to time including, the Sign-up process (“Register”, “Registration” or “Sign-up”) or (ii) by participating in the Promo Code Program (iii) Join the True Membership Program and purchase or add members for earn Group Cashback To redeem points given to you, you should visit True Balance to use Free Points or Emergency Loan.

CASHBACK

Cashback is one of the methods for giving reward to users.

GEM

‘Gem’ is a type of True Balance reward given to users in the Lucky Spin promotion. The user can earn Gems by winning Lucky Spin. And User can spend Gems to either play Lucky Spin or exchange for True Balance Free Point, but cannot use for making transactions. 100 Gems is worth ₹1 (True Balance Free Point). Gem validity period is one year from the date of earning.

REFERRAL REWARDS PROGRAM

Referred friends (each a “New User”, “Referred”, “Referee”) that have registered for a True Balance account with a valid referral code sent from an original Referrer (“Referrer”) will also receive Rewards for registration (the “New User Credit”). The New User Credit will be credited to the new user’s account after completing the Registration and entering the referral code (“Referral Code”, “Referral Link”, “Link”, “Invite”, “Invite Link”) shared by the original Referrer to redeem.

After the completion of Registration, both Referrer and Referred friends may receive Referral Rewards. True Balance has the sole discretion to change, suspend or modify the Rewards amount and the Tasks at any time without prior notice, at its sole discretion. Presently, the maximum number of Referral Rewards which can be received by the original Referrer through valid referral code is 10,000. Once this limit is exhausted, no reward will be awarded to Referrer and Referee. This limit can be changed without any prior notice at company’s discretion

REDEEMING REFERRAL REWARDS

Each Referred User must redeem the Referral Code, by entering it in the True Balance application if the system fails to read it automatically and complete the registration. Referral Rewards can be redeemed when the True Balance User next recharges and will be removed from the True Balance User’s account upon its expiration. Referral Points and New User Credits may not be (i) transferred or exchanged for any cash or money or (ii) earned by creating multiple True Balance accounts that are owned by one User. Referral Points and New User Credits accrued in multiple True Balance accounts may not be combined into one True Balance account.

SHARING REFERRALS AND PERSONAL INFORMATION

Referrals should only be used for personal and non-commercial purposes and should only be shared with personal connections. Referral Code should not be published or distributed where there is no reasonable basis for believing that all or most of the recipients are personal friends (such as coupon or websites, personal blogs, Reddit, or Quora). Referrals shall not be made using spamming tactics. As part of the Referrer being able to receive rewards for completion of each Task, the Referee acknowledges, understands and agrees that when Referee accepts and completes each Task, the Referrer will know that the Referee has completed one’s Task. All the communication related to the rejection of receiving Rewards will be communicated to the applicant and True Balance only and will not be sent to the referring customer. Referrer can only check the status of their reference by proactively login to the True Balance application.

MULTIPLE REFERRALS

Referred friend may only use one Referral Code. If a referred friend receives Referral Codes from multiple True Balance Users, only one corresponding True Balance User of the Referral Code actually used by the Referred when setting up a True Balance account will receive Referral Points.

  • True Balance User who signs up for a new True Balance account must redeem the Referral Code to get referral rewards if the system fails to read it automatically. Each Referred User upon redeeming the Referral Code will automatically get Registration Reward.
  • To get Reward, New User who registers for a True Balance account should not have registered its mobile device or mobile number with True Balance before.
  • Both Referrer and Referee will get rewards as Invite Reward if True Balance confirms New User, who received the invitation message, downloaded it via the unique Referral Link and completed the registration process in True Balance.

GENERAL

If the incentivized Task and/or anything to be done by True Balance in respect of the incentivized Task is prevented or delayed by causes, circumstances or events beyond the control of True Balance, including but not limited to computer viruses, tampering, unauthorized intervention, interception, fraud, technical failures, acts of government or other causes of like or similar or other character beyond the control of True Balance, then True Balance shall not be liable for the same to the extent so prevented or delayed, and will not be liable for any consequential damages.

PROMO CODE PROGRAM

The Promo Code Program (“Promo Code”) is one of the promotional programs offered by True Balance. Enrolment in the Program is automatic for all eligible True Balance Users. Users are eligible to attain Points through Cashback once applying a Promo Code on the purchase of the product provided by True Balance. To which purchase or payment Promo Code is applicable is solely at discretion of True Balance and can be changed at any point of time without prior notice. By participating in this Program, Users may receive a certain amount of Cashback on Qualifying Transactions. An eligible 20 Sep 2017 Promo Code offer including (i) Cashback amount (“Free Points”), (ii) Number of Cashback Uses, (iii) Minimum/Maximum amount of payment (iv) effective date may, from time to time, subject to change as per the discretion of True Balance.

ELIGIBILITY OF TRANSACTION

Qualifying transactions are defined as (i) transactions done directly through Payment Gateways (Credit Card, Debit Card or Net Banking) or Wallet Money stored in True Balance Wallet and or Gift Card (ii) use of a designated promo code provided by True Balance. All qualifying transactions made by a User under the Program are eligible to earn Cashback.

The following transactions are expressly excluded from the Promo Code Program:

  • Free Point Transaction or amount that paid with Free Point
  • More than 5 transactions done on the same day through the same bank
  • Payments with Virtual Cards & International Cards which are issued outside India
  • Cancelled Orders

GENERAL

  • In case of refund, allow the card issuer up to 7 business days.
  • Fraud and/or abuse relative to earnings of Points through Promo Code Program may result in forfeiture of Points as well as termination and cancellation of the True Balance Service.
  • True Balance reserves the right to cancel, suspend, change or substitute the Cashback or terms and conditions of the Program or the basis of Cashback at any time, without giving any intimation to the True Balance Use

GIFT CARD CASHBACK

Gift Card Cashback is offered to Users who purchase True Balance Gift Cards(hereinafter referred to as ‘Purchaser’). Gift Card Cashback will be given to purchasers once the Gift Cards are successfully added(“Redeem” or “Claim”) in True Balance accounts. The percentage of Gift Card Cashback may be changed according to True Membership relationship between the purchaser and redeemer(“the user who redeemed the Gift Card”) and over time. When Gift Card Cashback is paid, the Cashback percentage is calculated based on the purchase date.

TRUE MEMBERSHIP PROGRAM

PLEASE READ THESE TERMS AND CONDITIONS FOR TRUE MEMBERSHIP PROGRAM CAREFULLY. BY ACCESSING OR USING THIS PROMOTIONAL PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ANY OF THESE TERMS AND CONDITIONS, DO NOT PARTICIPATE IN THIS PROGRAM.

DEFINITIONS

  • True Balance's Membership program has changed from "Recharge Membership" to "True Membership" from 19th September 2019.
  • “True Balance” means The True Balance App which is provided by Balance Hero India or Balancehero India Pvt. Ltd (in any case, “Balance Hero”).
  • “Users” (“True Balance User”, “You”, “Customer registered with True Balance”, “User”, or “Participants”) means users who has signed up for True Balance app versions that supports True Membership program.
  • “True Membership Program” (“True Membership” or “Membership”) means users registered for True Balance Reward program for getting reward points for using True Balance services where user points will be accumulated.
  • “Cashback” means giving reward to true balance users.
  • “Free Point” means Cashback or reward points earned by True Balance under the “True Membership Program”. Users are awarded free points for earn activities carried out by the True Balance App.
  • “Gold Member” ("Gold Plus Member") means the Parent (also known as “First Person”) who become a Gold Member (or Gold Plus Member).
  • “Group Member” means the Child (also known as “Second Person/Generation”) or Grand Child (also known as “Third Person/Generation”) who have joined a Gold Member or Parent's Group.

TRUE MEMBERSHIP DETAILS:

True Membership Program is one of the promotional programs offered by True Balance. The True Membership Program is enrolled automatically to True Balance Users who installed True Balance App and signed in to our service. This program made for ‘Group’ relationship between True Balance users and User can earn more ‘Group Rewards’ from Group Member’s transactions. Also, User can earn more Reward on the purchase, even if User didn’t have any Group relationship with others.

ELIGIBILITY:

  • The Rewards Programme is open to all True Balance Users.
  • You will not be considered “Eligible” to use Our Services unless You reside in India; and have attained at least 18 (eighteen) years of age.
  • Using Services to perform transactions in Indian Rupees only and no other currency.
  • Avail of Services on a networked device which supports Services.
  • You may avail services only if you are Eligible. If you are not Eligible, please immediately abandon any and all attempts to register with us.
  • We reserve the right to immediately terminate Your Account if we have reason to believe that your Account is being used by any person who is not Eligible, or for any other reason.
  • We rely completely on Your representation that You are Eligible and will bear no liability if You or anyone who uses Your Account is found to be not Eligible.

GRADES OF MEMBERSHIP

  • Every user can join ‘True Membership program.’
  • When ‘User’ has met the conditions for Gold Member, user’s Membership grade will be updated immediately and first Gold Member will remain until the end of the following month.
  • To become a Gold Member, a user has to meet star amount based on order amounts.
  • When 'Gold Member' has met the conditions for Gold Plus Member, user's Membership grade will be updated as a 'Gold Plus Member'.
  • To become a Gold Plus Member, Gold Member has to meet star amount and finish KYC certification (must be certified with your aadhaar number or PAN card number).
  • On meeting the terms & conditions required for True Membership completed in current month, User’s membership grade will be updated to Gold(or Gold Plus) 1st day of the consequent month and updated membership grade will be intact for the said month.(Except when ‘User’ first becomes a ‘Gold Member(or Gold Plus Member)’))
  • If a user failed to meet the conditions for Gold Member (or Gold Plus Member) current month, user’s Membership grade will be downgraded to Regular Member grade in the consequent month.
  • The conditions for Gold Member and Gold Plus Member can have difference depends on current user grade.

GOLD BONUS

  • ‘Gold Bonus’ is a special bonus given to users who get the Gold Member first time.
  • If the user’s grade is upgraded to ‘Gold Member’ for the first time, Gold Bonus also send to users of the group to which the user belongs if below conditions are met:
  • To earn Gold Bonus from Group Members, every member who joins Group relationship must have Gold Member.
  • There is a limit to the number of Gold Bonuses that can be earned through Group Members.

GOLD PLUS BONUS

  • Gold Plus Bonus’ is a special bonus given to users who get the Gold Plus Member first time.
  • If the user’s grade is upgraded to ‘Gold Plus Member’ for the first time, only the user will receive the bonus.

GROUP RELATIONSHIP

The Group relationship will be valid in acceptanceto the following terms & conditions:

  • Every user can join only one Group (irrelevant of user’s grade).
  • Only the New User* can join Group.
  • A user can not join if a user who have a group has blocked status.
  • A user can not join the Group when the Group reaches the maximum member limitation.
  • A user can not rejoin the Group when the user was joined before.
  • Maximum member limitation can be changed without prior notice and at company’s discretion.
  • To Join Group, User must have a valid account and signed in with True Balance App with version that support True Membership Program.

GROUP REWARDS

  • User can earn Group Rewards based on order amounts from Group Members.
  • For earn Group Rewards from Group Members, every member who joined Group relationship must has Gold Member.
  • Group Rewards that earned during user blocked period, True Balance will not accrue reward points arising due to blocked user or any fraudulent activity by user/users.

GENERAL

  • In True Membership Program, only completed order amounts will be admitted.
  • Following conditions will not accrue reward points:
  • Free Point transaction or amount that paid with Free Point.
  • Paid with Virtual Cards & International Cards which are issued outside of India.
  • Cancelled or incomplete Orders.
  • Total reward (include Gold Member Bonus and Group Reward) has monthly limitation.
  • Reward Points are non-transferable.
  • To prevent fraud or cheat, excessive recharge order amounts can apply differential reward rate and this limitation can be renewed each month
  • To protect User’s right, True Balance can have continuous monitoring system to detect cheating and prevent fraud. True Balance reserved the rights to refuse/or deny Cashback on fraudulent transaction.
  • True Balance reserves the right to extend or terminate any/all offers provided under the True Membership Reward (the “Programme”) from time to time without prior notice.
  • True Balance reserves the right at any time, without prior notice, to add / alter / modify / change or vary these terms & conditions or to replace wholly, or in part, the offer(s) provided from time to time by another offer(s), whether similar to the modified/deleted offer or not, or to withdraw the said offer(s) altogether.
  • Reward rate will be applied separately based each Membership Grade and Admitted order amounts.
  • True Membership Programme can have limitations for reward transaction each day by the order of arrival/First come first serve basis.
  • True Membership Programme requires True Balance app with a supported version.
  • True Balance reserves the right to cancel, suspend, change or substitute the Reward or terms and conditions of the Program or the basis of Cashback at any time, without giving any intimation to User.

DISPUTE

  • True Balance computation of Reward Points shall be final, conclusive and binding on users and will not be liable to be disputed or questioned, save and except in case of manifest error
  • All dispute related to the Reward Program must be referred to us as soon as they arise.
  • Laws of India shall exclusively govern any disputes relating to these Terms and Conditions. Any disputes or lawsuits arising from these Terms and Conditions shall be brought in the District Court of Gurgaon, India, which will have sole and exclusive jurisdiction for the first instance.
  • Fraud and abuse relating to earning and redemption of Reward points in the Rewards Program will result in forfeiture of accrued points as well as termination of user account and/or from the Reward Program.

LUCKY SPIN PROMOTION

Lucky Spin promotion is offered to Users who are using 3.03 or upper app version. Users can earn Gems (True Balance In-app point) as a reward for playing Lucky Spin. True Balance reserves the right to modify, pause or terminate Lucky Spin promotion without prior notice.

We allow partners, businesses and advertisers (collectively, “Advertisers”) to provide users with a variety of ways (“Extra Earning Activities”, or “Offers”) to earn bonus rewards(“Points,” “Incentives”, or “Rewards”). Advertisers deliver attractive ads, coupons, deals, and other advertising content (collectively, “Ad Content”) through True Balance. Users are allowed to earn rewards by downloading, installing, playing or watching Ad Content. Extra Earning Activities are made available to Users based on a variety of factors, including physical location, Android OS, Smartphone device and participation level with True Balance. True Balance and our Advertisers make no guarantees regarding the number of rewards amount of Extra Earning Activities that will be available to Users at any time.

  • Participation

When a User completes an Offer through True Balance, they are creating a direct relationship with the Advertiser, who provided the Offer. Users should review the Advertiser’s Terms and Conditions relating to the Offer before completing the Offer. True Balance assumes no liability, obligation, or responsibility for any Offer on True Balance, or for any subsequent billing or relationship that occurs between User and Advertiser. Users should contact the Advertiser directly if they have any questions or disputes relating to the Offer.

Some Offers provide additional incentives, such as gift cards, for completing the Offer. In these cases, the incentive is provided directly by the Advertiser to the User and is independent of True Balance Offer. There may be additional requirements to receive these incentives beyond what is required to receive credit from True Balance. Balance Hero is not responsible for these additional incentives.

  • Completion of Offers/Extra Earning Activities

Unless otherwise stated, Offers are available only for Users who have applied for the Offer for the first time. Users will not be credited for completing an Offer if they have completed the Offer in the past, through True Balance, any other website, app, or social network, completion of or participation in offers, interactions with Advertisers, or with the Advertiser directly. From time to time, Balance Hero may enter into a business relationship with other entities that may involve tracking, collection, and disclosure of certain information regarding Users. For example, we might engage a third party market research firm that will track a User’s physical location through geo-tracking or mobile technology for market research purposes. Additional privacy policy which states details of the collections and use of such location information will be provided to the Users when we engage the third party market research firm. A User may choose to opt-out or opt-in to this experience and offer.

  • Crediting of Offers/Cash Earning Activities

Most Offers will be credited to the User’s True Balance account within a few business days from completion while others may take up to forty-five (45) days to credit. Users should read and comply with all requirements of an Offer to ensure timely credit. Users can redeem the rewards on Wallet. True Balance credits Users for completing Offers based on information we receive from our Advertisers. Thus, the Advertiser has the final say in whether or not a User is credited for completing an Offer. True Balance makes no guarantee that Users will receive credit for completing an Offer. Users should save all confirmation/welcome emails (and similar information) they receive from the Advertiser after completing an Offer. This information can often be used to credit a User’s account if not done automatically. If you have any questions about these Terms or any Offers or Product, please contact the Offers page creator/holder; Advertiser or True Balance. If you download any materials from this service, you do so at your discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such materials. Balance Hero does not make any warranties or representations regarding the use of the materials on this service in terms of their completeness, correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Balance Hero reserves the right, in our sole discretion, to terminate a User’s account and cancel all Points or other items posted to their Account, in addition to any other legal remedies, in the event that a User’s activity appears fraudulent.

GENERAL & ADDITIONAL TERMS

To participate in promotions, True Balance Users must make sure that they are using the latest version of True Balance App. Any True Balance User who used an outdated version to participate in offers is not eligible to get Rewards.

The offers are only valid for Prepaid SIM (“Prepaid Number” or “Prepaid SIM”) users, unless otherwise is expressly stated in the applicable terms of any particular offer.

Balance Hero reserves the right to amend, suspend or terminate the programs/ promotions, including their requisites and reward mechanism or a user’s ability to participate in promotions, or alter, modify, withdraw all or any of the Terms and Conditions or replace, wholly or in part, the program by any other program, whether similar to this program or not or withdraw it altogether, at any time and its sole discretion without prior notice or liability to the User.

Points earned as a result of fraudulent activities or earned in violation of the Terms and Conditions or any other constituent terms of the Balance Hero App are null and void. We reserve the right to suspend accounts or remove referrals or forfeit Free Points if we notice any activity that we believe is abusive or fraudulent or circumvent or violate these Terms and Conditions in any manner. We reserve the right to review and investigate all activities and to suspend or cancel Your accounts or modify or forfeit Free Points/ Gems as we deem fair and appropriate in our sole discretion. Non-fraudulent accrued Points may not be affected by suspension or termination of promotions or a User’s participation, as maybe determined solely by Balance Hero.

User voluntarily agrees and acknowledges that Balance Hero’s determination and decision on any violation of the Terms and Conditions or any other applicable terms published anywhere else on Balance Hero App shall be final and binding on the User.

Laws of India shall exclusively govern any disputes relating to these Terms and Conditions. Any disputes or lawsuits arising from these Terms and Conditions shall be exclusively brought in the appropriate Court of Gurugram, India. The User hereby waives its right of preference to any other jurisdiction for any kind of matter arising of these Terms and Conditions.

You and Us shall be subject to TERMS OF SERVICE of Balance Hero for the respects that are not defined in these Terms and Conditions. If there is any conflict between these Terms and Conditions and TERMS OF SERVICE of Balance Hero, these Terms and Conditions shall prevail.

Points are valid for 1 year from the date they were earned, unless as expressly stated in the applicable terms of any offer.

Applicability of the aforementioned terms and determination of fulfilment of eligibility and governing criteria shall be at the sole discretion of Balance Hero. You agree and acknowledge that Balance Hero’s decision on any matter pertaining to these Terms and Conditions shall be final and binding on You.

You agree and acknowledge shall Balance Hero shall be the sole authority on the interpretation of these Terms and Conditions.

User agrees and acknowledges that availing the use of Balance Hero App or any of its promotions constitutes an acknowledgment and acceptance by the User of these Terms and Conditions and other applicable terms published by Balance Hero. If the User does not agree with any part of such terms, conditions and notices, it is the responsibility of User to not avail Balance Hero App or any of its constituent services and/ or promotions.
